Objective
The aim of this study unit is to familiarize students to chartering agreements: negotiations in shipping, practices and contract interpretation; most general carriage agreements, voyage chartering, time charters and bareboat charters and use of additional clauses. Agreements in operation of ships; the roles, operational responsibilities and liabilities of agents, carriage brokers, insurance and ship brokers.
After completing the course students understand:
- Contracts concerning chartering; especially voyage-, time charter and bareboat carriage as well as the relevant English terminology.
- They are able to operate on the basis of these contracts in an international environment.
- Students are capable of analyzing and drafting contracts for the shipowner, dispatching or transportation company, both aboard and in the land-based operations.
- They can be in charge of company’s agreements and train company’s staff about them as well as acquire information about dispute resolution of individual agreements.
- Students are familiar with liabilities and responsibilities of different contractual parties, such as agents, insurance brokers, shipbrokers and others.
- Students can analyze changes to commercial and chartering agreements for shipping required by use of new fuels and introduction of autonomous shipping (MASS).
Content
- Agreement negotiations in shipping, practices and interpretation;
- Most general carriage agreements,
- Carriers obligations and liabilities as well as liberties to deviate from planned voyages and to change loading and discharging ports in war-like situations
- Law and practise relating to voyage chartering, time charters and bareboat charters and use of additional clauses in English and Nordic Law. Insight to differences in Chinese compared to previous.
- Agreements in operation of ships; the roles, operational responsibilities and liabilities of agents, carriage brokers, insurance and ship brokers.
- Future changes in legislation and contracts as well as contract practices caused by new fuels and autonomous shipping.
Qualifications
Common Advanced Professional Studies 10 ECTS and Agreed Documents and International Maritime Treaty Obligations 5 cr as well as Risk Management in Shipping - Marine Insurance Law and Contracts 5 cr have to be completed before attending.
